Most family law matters, like divorces, are heard by the Federal Circuit and Family Law Court of Australia.

Family law matters heard in the Magistrates Court

The Magistrates Court of Tasmania can hear limited types of family law matters such as:

  • property settlements, or
  • parenting orders.

A parenting order made by the Federal Circuit and Family Law Court of Australia will usually override a family violence order (FVO).  A magistrate making a family violence order may decide to change, suspend or revive a parenting order to make sure that the FVO and the parenting order are consistent with each other.
