No 2 of 2005 - Magistrates Court Civil Division – Adjournment Procedures

Pursuant to the Magistrates Court Act 1987 section 15AA, I issue the following Practice Direction in relation to the Magistrates Court (Civil Division) Rules 1998.

The Magistrates Court (Civil Division) Rules 1998, r74(3)(b) provides for the adjournment of a hearing of an application to a ‘fixed date only’; r88(c) provides for a conciliation conference to be adjourned to a ‘fixed date only’ and r97(4) provides for adjournment of a trial to ‘fixed date only’. In keeping with the philosophy of the Magistrates Court (Civil Division) Rules 1998, in future, an application for a matter to be adjourned will only be to ‘a fixed date’ or to ‘a date to be fixed by the Registry’.
