Minor Civil Claims - Solicitors Costs

I refer to my Circular dated 18 October 2004.

Following detailed submissions from Counsel heard in Court yesterday, a Magistrate has reviewed her earlier ruling on this matter, and determined that solicitors costs on originating process are recoverable on minor civil claims.

However, after a Defence is filed in a minor civil claim, legal representation is only permitted in the circumstances set out in s.31AD of the Magistrates Court (Civil Division) Act 1992.

Accordingly, I advise that the Registry is now accepting for filing Minor Civil Claims and applications for Default Judgment which include solicitors costs.
